Early Release, Terms and Condtions & Direct Debit Service Agreement

Early Release

If you ordered a promotional photo in your photo order, you may have early access to it. We look forward to getting this to you. To release the promotional 10x13” photo, pay $100 on the day the photos are taken. Payments on the Picture Perfect flexible payment plan do not count toward your deposit. Alternatively, once you have paid $300 toward your *Picture Perfect flexible payment plan, please contact the office. To release your promotional 10x13” photo and 16x20” poster, pay $300 on the day the photos are taken or by the agreed date. Your payment plan must remain active, with the first scheduled payment successfully processed. If a payment fails, two consecutive further successful payments must be made before any photo release. Any $35.00 postage fee must be paid or added to the order before release. *Promotional photos are extra copies of images already purchased.

Picture Perfect - Flexible Payment Plan - Terms and Conditions

There are No Cancellations / Changes or Refunds for change of mind or circumstance to your order. ________________________________________ Picture Perfect - Flexible Payment Plan - Terms & Conditions These Payment Plan Terms & Conditions apply to any approved payment arrangement entered into with **Pic Perfect Pty Ltd ATF Oscar-Lee Family Trust T/A Picture Perfect Photographic Studios**. By entering into a payment plan, you agree to these terms, together with any related order terms, Direct Debit Request, and Direct Debit Service Agreement, where applicable. You 1. Flexible Payment Plans and Changes We understand that circumstances may change and will always try to work with you where clear communication is maintained. You must provide at least **fourteen (14) days’ written notice** for any requested change, deferral, pause, increase, reduction, or update to your payment arrangement. Any change is subject to approval at our discretion. Until approved, you remain responsible for maintaining your existing payment arrangement and keeping your contact and payment details up to date. We may amend these terms or adjust fees by giving you at least **fourteen (14) days’ written notice**. Any approved changes will apply to active accounts from the date stated in that notice. 2. Your Order All orders are custom-made and final once placed. We do not provide cancellations, refunds, reductions, or changes for change of mind or change of circumstances. This includes, but is not limited to, financial changes, relationship changes, relocation, loss of interest, or a change in preference after the order has been placed. Nothing in these terms excludes, restricts, or modifies any rights you may have under the Australian Consumer Law. 3. Payments, Fees and Failed Payments A **$2.00 transaction fee** applies to each payment. If a scheduled payment fails, we may retry the payment, adjust the schedule, or take reasonable recovery action. A **$10.00 dishonour fee** may apply to each missed or failed scheduled payment. Any fees charged by your own financial institution are your responsibility. If payments are stopped, missed, or the account is not actively maintained by you during a calendar month, a **$6.00 monthly account keeping fee** may be applied to cover administration, account monitoring, payment follow-up, and ongoing account management. 4. Chargebacks, Reversals and Payment Disputes If a chargeback, payment reversal, or payment dispute is raised on a payment payable to us, a **$35.00 administration fee** may be added to your account. Any bank, merchant, processor, platform, or related fees incurred by us may also be added to your account where legally recoverable. 5. Multiple Invoices and Account Allocation Where multiple invoices exist, payments will be applied to the oldest outstanding balance first, unless a payment is made in full toward a specific invoice. If a payment is reversed, disputed, charged back, or remains unpaid, the unpaid amount may be treated as an outstanding debt and any applicable fees may be added to the account. 6. Overdue Accounts and Recovery Action Where permitted by law, overdue accounts may be referred to external recovery agents, solicitors, or credit reporting bodies. Default information will only be disclosed where legal requirements are met, including where the debt is at least **$150.00**, is overdue by at least **60 days**, and any required notices have been issued. Overdue debts may affect your credit rating. Any legally recoverable recovery, legal, administration, or credit reporting costs actually incurred by us may be added to your account. 7. Paid in Full, Release and Postage Once your account is paid in full, we will confirm your contact details before dispatch. Delivery is approximately **3 weeks** after final payment approval and contact detail confirmation. Any outstanding fees must be paid before release. If we cannot contact you, a **$10.00 monthly storage fee** may apply. If your product is returned after being posted to your confirmed address, a **$50.00 return handling and re-postage fee** may apply. 8. Privacy and Account Information We will take reasonable steps to keep your personal records, account details, and payment information confidential. Your information may be shared with authorised partners, payment providers, financial institutions, recovery agents, legal providers, credit reporting bodies, or other authorised service providers where reasonably required to administer your account, process payments, investigate payment issues, recover overdue amounts, or comply with legal obligations. 9. Contact and Communication We may use the contact details you have provided to contact you by post, text message, phone call, email, or social media. We may use authorised automated systems and technology tools to administer accounts, process payments, send reminders, and communicate with you about your account. You are responsible for keeping your contact and payment details up to date. 10. Hardship We will always try to work with you where clear communication is maintained. We may vary, reduce, or waive fees in cases of financial hardship or exceptional circumstances, at our sole discretion. 11. Jurisdiction This agreement, the Direct Debit Request, and the Direct Debit Service Agreement are governed by the laws of **Queensland, Australia**. You and we submit to the non-exclusive jurisdiction of the courts and tribunals of Queensland in relation to any dispute arising out of or connected with these terms. 12. Acknowledgement By entering into a payment plan, you acknowledge and agree that: * your order remains payable in full; * your payment plan must be maintained as approved; * requested changes require at least fourteen (14) days’ written notice; * fees may apply to failed payments, chargebacks, inactive accounts, storage, postage, and recovery action; * your order will not be released until paid in full, and all applicable fees are cleared; * overdue accounts may be referred for recovery action where permitted by law; and * you are responsible for keeping your contact and payment details current.

Direct Debit Service Agreement

The following is your Direct Debit Service Agreement with Pic Perfect Pty Ltd ATF The Oscar-Lee Family Trust T/A Picture Perfect Photographic Studios ABN-44 616 644 674 (the “Merchant”). The agreement explains your obligations when entering into a Direct Debit arrangement with the Merchant. It also details what the Merchant’s obligations are to you as the Direct Debit Initiator. We recommend you keep this agreement in a safe place for future reference. It forms part of the terms and conditions of your Direct Debit Request (DDR) and should be read in conjunction with your DDR form. Definitions Account means the account held at your financial institution from which we are authorised to arrange for funds to be debited. Agreement means this Direct Debit Request Service Agreement between you and the Merchant Banking day means a day other than a Saturday or a Sunday or a public holiday listed throughout Australia Debit day means the day that payment by you to the Merchant is due Debit payment means a particular transaction where a debit is made Direct debit request means the Direct Debit Request between the Merchant and you Merchant means the organisation you have authorised by signing a direct debit request and as defined above You means the customer who signed the Direct Debit Request Your financial institution means the financial institution nominated by you on the DDR at which the account is maintained. 1. Debiting your account By signing a Direct Debit Request, you have authorised the Merchant to debit funds from your account. You should refer to the Direct Debit Request and this agreement for the terms of the arrangement between you and the Merchant. The Merchant will only arrange for funds to be debited from your account as authorised in the Direct Debit Request. If the debit day falls on a non-banking day, the Merchant may direct your financial institution to debit your account on the following banking day. If you are unsure about which day your account has or will be debited you should ask your financial institution. 2. Amendments by the merchant The merchant may vary any details of this agreement or a Direct Debit Request at any time by giving you at least fourteen (14) days’ written notice. 3. Amendments by you You may change, stop or defer a debit payment, or terminate this agreement by providing the Merchant with at least fourteen (14) days’ notification by contacting the Merchant during business hours or arranging it through your own financial institution. 4. Your obligations It is your responsibility to ensure that sufficient cleared funds are available in your account to allow a debit payment to be made in accordance with the Direct Debit Request. If there are insufficient clear funds in your account to meet a debit payment: a) You may be charged a fee and/or interest by your financial institution; and b) You must arrange for the debit payment to be made by another method or arrange for sufficient clear funds to be in your account by an agreed time so that the Merchant can process the debit payment. You should check your account statement to verify that the amounts debited from your account are correct. 5. Dispute If you believe that there has been an error in debiting your account, you should notify the Merchant directly. Alternatively, you can take it up with your financial institution directly. If the Merchant concludes as a result of investigations that your account has been incorrectly debited the Merchant will respond to your query by arranging for your financial institution to adjust your account (including interest and charges) accordingly. The Merchant will also notify you in writing of the amount by which your account has been adjusted. If the Merchant has concluded that as a result of investigations that your account has not been incorrectly debited, the Merchant will respond to your query by providing you with reasons and any evidence for this finding in writing. 6. Accounts You should check: a) With your financial institution whether direct debiting is available from your account as direct debiting is not available on all accounts offered by financial institutions. b) Your account details which you have provided to us are correct by checking them against a recent account statement; and c) With your financial institution before completing the Direct Debit Request if you have any queries about how to complete the Direct Debit Request. 7. Confidentiality The Merchant will keep any information (including your account details) in your Direct Debit Request confidential. The Merchant will make reasonable efforts to keep any such information held secure and to ensure that any of the Merchants employees or agents who have access to information about you do not make any unauthorised use, modification, reproduction or disclosure of that information. The Merchant will only disclose information held about you: a) To the extent specifically required by law; or. b) For the purposes of this agreement (including disclosing information in connection with any query or claim to your Financial Institution). 8. Notice The Merchant will notify you by email at the address provided in the Direct Debit Request. Should you need to contact the Merchant, please call or email the Merchant directly. Notice will be deemed to have been received at the time of transmission of the notification email. .
